July 18, Minsk /correspondent of BelTA/. On July 18 President of Belarus Alexander Lukashenko signed Decree No 246 introducing amendments to Decree No 504 of October 15, 2007 “On Certain Measures of Regulation of Vehicles Sale Transactions”. This was reported to BELTA by the press service of the head of state.
With a view to protecting people from dishonest participants of transactions in car alienation some acting provisions, regulating the market of transport vehicles, have been specified taking into consideration law enforcement practice. In particular, the possibility of transactions for the sale of vehicles through the execution of reference documents and cash settlements between legal entities, individual entrepreneurs and individuals under such contracts has been excluded. The right to choose the form of payment for transactions between individuals has been retained.
The document introduces the obligation to enter into contracts for the disposal of vehicles only in writing. The decree also provides for requirements to reflect in the contract information about the absence of restrictions (encumbrances) and prohibitions on the transactions with the vehicle.
Now vehicle sale and purchase agreements between individuals may receive state registration not only in the relevant registration authorities (traffic police and the Ministry of Agriculture) but also through notarization.
These provisions of the decree will come into force six months after its official publication.
